OFFICE MEMORANDUM

Subject: Instructions for the purchase of laptops/notebooks and similar devices for eligible officers - revised guidelines.

In supersession to this Ministry's Office Memorandum bearing No. 08(64)/2017-E.II(A) dated 27th September 2016, regarding purchase of Note Book/Lap-Top computers by Ministries/ Departments & delegation of powers thereof, it has been decided that laptop; tablet; notepad; ultra-book; notebook, net-book or devices of similar categories may be issued to officers of the rank of Deputy Secretary and above for discharge of official work. These powers shall continue to be exercised in consultation with the Financial Adviser by the Secretary of the Ministry/ Department or any other authority who are specifically delegated these powers by this Ministry from time to time, duly taking into consideration the functional requirements and budgetary provisions.

2. This would, however, be subject to the following conditions:

(i) Cost of device: The Cost of device including Standard software shall not exceed Rs. 80,000/-
Standard Software: Any software (Operating System, Antivirus software or MS-Office etc.) that is essential for the running of device towards discharge of official functions/duties.

(ii) Purchase Procedures: As prescribed under GFRS/CVC guidelines may be followed.

(iii) Safety, Security & Maintenance of Device: The officer, who is given the device, shall be personally responsible for its safety and security as well as security of data/information, though the device shall continue to remain Government property. The officer concerned will be at liberty to get the device insured at his personal cost.

(iv) Retention/Replacement of device:

a) No new device may be sanctioned to an officer, who has already been allotted a device, in a Ministry /Department, up to five years. Any further issue of laptop in case of loss/damage beyond repairs within the prescribed period, should be considered only after the cost is recovered from the officer based on the book value after deducting the depreciation.

b) For the purpose of calculation of the book value, a depreciation of 25% per year, on straight line method, be adopted.

c) Post the completion of five years of usage, the officer shall retain the issued device.

(v) Conditions at the time of transfer, Superannuation etc.:

a) ln case where, at the time of purchase of device if the residual service of the officer is less than 5 years or in case the officer is transferred/deputed to State Govt. but with residual service of less than 5 years or the officer leaves the Government Service within 5 years of purchase of such device, the officer concerned will have the option of retaining the device by paying the amounl after deducting the depreciation.

b) Upon transfer/deputation of the officer to other Ministry/ Department Attached/ Subordinate offices of the Government of India or to the State Government in case of Officers of the All India Services, the officer will have the option of retaining the existing device and in case of such retention, this fact should be specifically mentioned in the Last Pay Certificate (LPC).

3. Instructions for Ministries/Departments:
(i) For the officials who are currently holding laptops, notebooks or similar devices in accordance with the provisions of O.M. dt. 27/09/2016, the terms & conditions for retention/disposal of the device shall continue to be governed under the existing instructions of the said O.M.

(ii) The applicability of the provisions of this order to the officers of Armed Forces / Para-Military Forces, officers of MoD & other similar establishments would be subject to restrictions imposed by the concerned departments/organizations duly taking into consideration the security of information. In all such cases the security of the information shall be the responsibility of the concerned department.

Subject: Fixation of pay and grant of increment in the revised pay structure —clarifications - regarding. 

Following the notification of Central Civil Servises Rules 2016,this Department has received references seeking clarifications regarding various aspects or  of pay in the revised pay structure as also pay fixation and grant of increment in future under revised pay structure. The matter has been considered in this Department and the points of doubts are clarified as under:

As per the provisions of FR 22 (I) (a) (1), the Government servants (other than those appointed on deputation to ex-cadre post or ad hoc basis or on direct recruitment basis) have the option, to be exercised within one month from the date of promotion, to have the pay fixed under this rule from the date of such promotion/ appointment or from the date of next increment.

Some of the employees, promoted between 01.01.2016 and the date of notification of CCS (RP) Rules, 2016 had opted for their pay fixation on promotion/financial up-gradation under MACPS from the date of their next increment in the lower grade. Consequent upon notification of CCS (RP) Rules, 2016 i.e 25th July, 2016, the option submitted by such employees has now turned out to be disadvantageous.

Whether such employee may be allowed to revise their option under FR 22 (I)(a)(1) at this stage.
Under the changed circumstances after notification of CCS (RP) Rules, 2016, the employee may be allowed to exercise revised option for fixation of pay under FR 22(I)(a)(1).Such revised option shall be exercised within one month of issue of this OM. Option so revised, shall be final

Whether employees appointed/promoted/ granted financial up-gradation during 02.01.2015 and 01.07.2015 will be entitled to grant of one increment on 01.01.2016.
Since the provisions of CCS (RP) Rules, 2016 are effective from 01.01.2016, no increment shall be allowed on 01.01.2016 at the time of fixation of pay in the revised pay structure.

2. I am further directed to inform that the Committee on Allowances has desired to meet the representatives of the National Joint Council of Action (NJCA) in the aforesaid meeting to obtain their views on the recommendations of 7th Central Pay Commission relating to allowances.

Subject: Clarification on admissibility of Transport Allowance in the cases where the officers are drawing Grade Pay of Rs.10,000/- in PB-4 — regarding.
Reference is invited to this Department’s Office Memorandum No.21(2)12008- E.II(B) dated 29.08.2008. Para ‘3’ of the O.M. stipulates that Officers drawing Grade Pay of Rs.10,000/- & above and those in the HAGS’ Scale, who are entitled to the use of official car in terms of Department of Expenditure (DoE) O.M. No. 20(5)/E.11(A)/93 dated 28.01.1994, shall be given the option to avail themselves of the existing facility or to draw the Transport Allowance at the rate of Rs.7,0001- p.m. plus Dearness Allowance thereon.
2. Several references have been received in this Department seeking clarification on the admissibility of Transport Allowance to officers drawing Grade Pay Rs. Rs.10,000/ under Dynamic ACP Scheme or NFU Scheme. A few cases have also been filed in the Courts in this regard. Hon’ble Central Administrative Tribunal (CAT), Principal Bench, New Delhi, in Order dated 13.05.2014 in O.A. No.4062/2013 filed by Shri Radhacharan Shakiya & Others Nils Union of India & Others, held that the Applicants were not entitled to draw Transport Allowance Rs.7,000/- p.m. plus DA thereon. The said order of the Tribunal has also been upheld by Hon’ble High Court of Delhi in their Order dated 03.09.2014 passed in Writ Petition (Civil) No. 3445/2014, filed by Shri Radhacharan Shakiya & Others,
3. Accordingly, it is clarified that the officers, who are not entitled for the use of official carfor commuting between residence to office and back, in terms of DoE’s OM 20(5)/E-I1(A)/93 dated 28.01.1994, are not eligible to opt for drawal of Transport Allowance @ Rs.7000/- p.m. + DA thereon, in terms of DoE O.M. No.21(2)/2008- E.II(B) dated 29.08.2008, even though they are drawing Grade Pay of Rs.10,0001- in PB-4 under Dynamic ACP Scheme or under the scheme of Non-Functional Upgradation (NFU).

Subject: Settlement of audit objections - formation of Committee.


It has been brought to the notice of this Ministry that a large number of Inspection Reports (IRs) / Audit Paras are pending with Ministries/Departments where even the first reply has not been furnished to Audit.

2.      As per C&AG Regulations 197, the replies to observations raised in Inspection Reports are to be furnished within four weeks of receipt. Where it is not feasible to furnish the final replies to some of the observations within the timeline, interim reply may be given indicating likely date of final reply. Timely settlement of audit objections is important as it involves taking remedial actions as well as streamlining of procedures. 

3.      Accordingly, in supersession of this Department's O.M. No. 12(9)/E-Coord/84 dated 1.1.1985 on the above mentioned subject, it has been decided that every Ministry/Department will set up a Committee at JS level as chairman and Under Secretary (Administration), Under Secretary (IFU) and DDO as member to settle the outstanding Inspection Reports & Audit Paras. The Committee may co-opt one member, if required, from the Division concerned with the IR/Audit Para. The Committee will meet as frequently as required to settle the audit objections. 

4.      Ministries/Departments are requested to insure that IRs/Audit Paras are attended to promptly so that they are not converted into full fledged audit paras.

5.      This issue with the approval of Joint Secretary (Pers).
