Clarification of Junior & Senior officials are getting same pay in Revised Pay Structure



In 7th CPC Fixation, situations may arise where pay of the Junior official is fixed at same stage with the pay of Senior official in revised pay structure.

For example:

A is drawing pay Rs. 11170 & B is drawing pay Rs.11510 in Pay Band 1 with Grade Pay 2400 in 6th CPC as on 31.12.2015.

Pay of A will be 11170*2.57 = 28707. He will be fixed in level 4 at stage 6 i.e. 29600

Pay of B will be 11510*2.57 = 29581. He will also be fixed in level 4 at stage 6 i.e. 29600

In this case Senior B is getting same pay as that of Junior A.

In 7th CPC report dated 19.11.2015, under point number 5.1.36 & 5.1.37,clarification regarding this is given.

5.1.36 Although the rationalisation has been done with utmost care to ensure minimum bunching at most levels, however if situation does arise whenever more than two stages are bunched together, one additional increment equal to 3 percent may be given for every two stages bunched, and pay fixed in the subsequent cell in the pay matrix.




5.1.37 For instance, if two persons drawing pay of ₹53,000 and ₹54,590 in the GP 10000 are to be fitted in the new pay matrix, the person drawing pay of ₹53,000 on multiplication by a factor of 2.57 will expect a pay corresponding to ₹1,36,210 and the person drawing pay of ₹54,590 on multiplication by a factor of 2.57 will expect a pay corresponding to ₹1,40,296. Revised pay of both should ideally be fixed in the first cell of level 15 in the pay of ₹1,44,200 but to avoid bunching the person drawing pay of ₹54,590 will get fixed in second cell of level 15 in the pay of ₹1,48,500.

But in 7th Pay Resolution dated 25.07.2016, is is not clarified whether 5.1.36 & 5.1.37 are accepted or not. Also in CCS Revised Pay Rules 2016, no such rule is given.

What's next??

As on now, pay of Senior may not be fixed to next stage in level, if situation mentioned above arise. Both officials may be fixed at same stage.
